Musab Hashmi & Associates practises in property title verification and legal opinions on property in Hyderabad and Telangana, including document review before purchase, Section 22-A prohibited-property checks, lake FTL and buffer zone position, Bhu Bharati records for agricultural land, and review of agreements of sale. This page explains what a property legal opinion covers. It is general legal information, not legal advice.

Begin document and portal checks before paying a booking or token amount. A registered sale deed, an Encumbrance Certificate, a tax receipt and a RERA registration answer different questions, and none of them is a complete guarantee that a purchase is safe.

Areas of practice: property legal opinion

MatterWhat the review looks at
Title verification before buying a flat, plot or houseThe seller’s title deed, the chain of link documents, the encumbrance certificate, approvals, dues and possession
Agricultural landThe Bhu Bharati record of rights, pattadar passbook, extent, and conversion status if you intend to build
Section 22-A prohibited-property checkWhether a matching entry appears on the Registration and Stamps Department’s prohibited-property search, and its basis if it does
Lake FTL and buffer zone positionThe HMDA lakes portal records, notification stage, cadastral map and affected survey numbers, with nala alignment and land use
Agreement of sale before bookingThe property schedule, price, payment milestones, possession terms, cancellation provisions and treatment of an adverse title finding
New projectsRERA registration where the project is covered, the sanctioned plan, and the underlying land’s title and FTL position

What a property legal opinion covers

A specific title opinion requires the documents, the exact property identification and the relevant searches. The usual checks are:

  1. Title deed: how the seller acquired the property. The name must match the seller’s identity documents, and the schedule of property (boundaries, extent, survey number, flat number) must match what is on the ground.
  2. Link documents: the chain of registered documents behind the title. Practitioners commonly examine up to thirty years of history where records permit. Gaps, unregistered “agreement” transfers, or GPA-based sales in the chain are warning signs that call for deeper scrutiny.
  3. Encumbrance certificate: registered transactions for the period and property description searched, read alongside the link documents. An outstanding mortgage entry with no registered release is a live charge.
  4. Prohibited-property list: a Section 22-A search by the property’s district, mandal and village, with any returned entry checked against the survey or subdivision number and extent.
  5. Lake FTL and buffer zone: the HMDA lakes portal records for the village, where the district is covered by the portal.
  6. Approvals: layout approval for plots, building permission and the sanctioned plan, occupancy certificate where applicable, and RERA registration for covered projects.
  7. Dues: property tax, electricity and water, and an association no-dues letter for apartments.
  8. Litigation: whether any suit, mortgage, family claim or acquisition proceeding touches the property.
  9. Possession and the ground: occupation, access and boundaries compared with the documents.

Telangana-specific checks

  • Bhu Bharati, not Dharani: Telangana’s agricultural land records moved off the Dharani portal. Bhu Bharati was launched on 14 April 2025 under the Telangana Bhu Bharati (Record of Rights in Land) Act and is now the current system. Guides, brokers and even some documents still say “Dharani”; treat those as out of date. Each land parcel is being assigned a Bhudhaar, a 14-digit unique land parcel identification number.
  • Section 22-A: a blank result or a portal outage on the prohibited-property search is not a title certificate or permission to register. A previous registration or a clean EC does not itself remove a Section 22-A restriction. See our Section 22-A guide.
  • Lakes and nalas: finding your survey number on the HMDA statement of affected survey numbers does not mean the whole plot is affected, and not finding it is not a clearance, because a boundary can pass through a survey number. Nalas and storm-water drains carry buffer restrictions too. See how to check FTL and buffer zone before buying and the free FTL and buffer zone check.
  • RERA scope: RERA registration concerns covered real-estate projects; it is inaccurate to say that every property transaction must have a new RERA registration. For a covered project, match the registration details, promoter, location and uploaded permissions to the unit offered.

What each record does not tell you

RecordTells youDoes not tell you
Sale deedHow the seller acquired the propertyWhether the earlier owners had good title
Encumbrance certificateRegistered transactions for the period and description searchedUnregistered claims, court cases, dues, lake or government land status
Prohibited-property searchWhether a matching entry appears on the date searchedThat a blank result is a clearance or a title certificate
HMDA lakes portalNotified lakes, maps and affected survey numbersThat absence from the list means the plot is clear
RERA registrationThe project is registered, with the developer’s disclosuresThe FTL position or title of the underlying land
Tax receipt, utility record or mutationPayment on that account; tax and utility records help show possessionOwnership

A seller cannot convey a better title than they hold, and mutation does not create title.

Relying on a bank, broker or seller’s document review

Ask for an independent review addressing your proposed purchase and the actual unit or parcel, with missing documents, qualifications and unresolved issues listed in writing. Loan approval does not establish that every title, boundary or regulatory question has been resolved. A builder’s brand is not a substitute for the documents either: reputed-builder projects still require checking RERA registration, the sanctioned plan, the land’s underlying title, its FTL position and the specific flat’s schedule.

Before you pay. Record promises about approvals or the removal of restrictions in the agreement. Do not pay on a promise that a Section 22-A entry will automatically be deleted.

Documents for a property review

  • the proposed agreement or sale deed, the seller’s title document and available link documents;
  • the encumbrance certificate with its search period and property identifiers, and copies of relevant registered entries;
  • survey, subdivision, village, plot or flat details and a location plan;
  • available revenue records, mutation entries and tax receipts;
  • layout and building permissions, any occupancy certificate and RERA project details;
  • mortgage, release, development-agreement, authority-to-sign or succession documents where relevant;
  • any notice, prohibited-list entry, refusal order, court order or pending-case details;
  • the booking receipt, payment record, correspondence and any approaching deadline.

This is a starting list, not a fixed list sufficient for every property. Keep originals safe and use copies for the initial review.

Frequently asked questions

What does a legal opinion on property in Hyderabad check?

The seller’s title deed and the chain of link documents, the encumbrance certificate, the Section 22-A prohibited-property list, the lake FTL and buffer zone position, approvals and RERA where applicable, dues, litigation, and possession on the ground. A specific opinion requires the documents, the exact property identification and the relevant searches.

How many years of documents should be checked?

Practitioners commonly examine up to thirty years of history where records permit, because a defect several transactions back travels down the chain to a present buyer.

Is a nil encumbrance certificate enough to buy safely?

No. An EC lists registered transactions for the period and description searched. It will generally not show unregistered agreements, pending court cases, dues, or statutory positions such as government land or a lake buffer zone, and a nil EC is not a legal opinion on ownership.

The bank has approved my home loan. Do I still need my own review?

Loan approval does not establish that every title, boundary or regulatory question has been resolved. An independent review addressing your purchase and the actual unit or parcel, with unresolved issues listed in writing, is a separate exercise.

My survey number is not on the HMDA affected list. Is the property clear?

Not on that basis alone. A boundary can pass through a survey number, so absence from the list is not a clearance. Use the cadastral map and a physical examination on the ground.

Do agricultural land records still use Dharani?

No. Bhu Bharati was launched on 14 April 2025 under the Telangana Bhu Bharati (Record of Rights in Land) Act and replaced Dharani. Verify the pattadar passbook, extent and the seller’s name in the current record of rights.

When should a property review be done?

Before paying a booking or token amount, so that material uncertainties can be resolved before committing further money.
